GDPR Privacy Policy—General Data Protection Regulation

This Privacy Policy describes how and when NAHFA collects, uses, and shares information when you interact with NAHFA to purchase/utilize an item/service, contact us, or otherwise use any services through NAHFA or its related partners.

This Privacy Policy does not apply to the practices of third parties that NAHFA does not own or control, or any third party services you access through NAHFA.

Information NAHFA Collects
To interact with NAHFA, you must provide certain information, such as your name, email address, postal address, payment information, and the details of the product/service that you’re ordering or inquiring about. You may also choose to provide additional personal information depending on the type of product/service you are ordering or inquiring about.

Why NAHFA Needs Your Information and How It Is Used
NAHFA relies on a number of legal bases to collect, use, and share your information, including: as needed to provide services, such as when your information is used to fulfill your order/request, to settle disputes, or to provide customer support; when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for a mailing list, registering for an event, entering a NAHFA showroom or other interaction with NAHFA; if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases/inquiry if required by tax law; and as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving NAHFA services. NAHFA uses your information to provide the services you requested and in NAHFA’s legitimate interest to improve NAHFA services.

Information Sharing and Disclosure
Information about customers is important to NAHFA. NAHFA shares your personal information for very limited reasons and in limited circumstances, as follows:
Partners. NAHFA shares information with service partners as necessary to provide you requested product/services.
Service providers. NAHFA engages certain trusted third parties to perform functions and provide services to NAHFA, such as delivery or mailing companies. NAHFA will share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If NAHFA were to merge with another business, NAHFA may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. NAHFA may collect, use, retain, and share your information if NAHFA has a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of NAHFA customers, or others.

Data Retention
NAHFA retains your personal information only for as long as necessary to provide you with services and as described in the Privacy Policy. However, NAHFA may also be required to retain this information to comply with legal and regulatory obligations, to resolve disputes, and to enforce NAHFA agreements. NAHFA generally keeps your data for the following time period: 10 years.

Transfers of Personal Information Outside the EU
NAHFA may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, NAHFA may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If NAHFA deems it necessary to transfer or host information about you outside of the EU, NAHFA will rely on Privacy Shield certified services.

Your Rights
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. NAHFA describes these rights below:
Access. You may have the right to access and receive a copy of the personal information NAHFA holds about you by contacting the data officer using the contact information below. Requests are generally responded to within 14 business days. If automated access is possible, you will be provided with log in credentials within 10 business days of verification of your identity.
Change, restrict, delete. You may also have rights to request a change, restrict my use of, or delete your personal information. Absent exceptional circumstances (like where NAHFA is required to store data for legal reasons) NAHFA will generally delete your personal information upon request. Any further interaction with NAHFA by you will be treated and stored as a new data record and not subject to the terms of previous change, restrict or delete requests.
Object. You can object to (i) NAHFA processing of some of your information based on NAHFA’s legitimate interests and (ii) receiving marketing messages from NAHFA after providing your express consent to receive them. In such cases, NAHFA will delete your personal information unless NAHFA has compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
Complain. If you reside in the EU and wish to raise a concern about NAHFA’s use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
