HFA Is Monitoring the Supreme Court’s Review of IEEPA Tariffs

The Home Furnishings Association (HFA) is closely following the latest developments surrounding the ongoing Supreme Court hearings on the legality of tariffs imposed under the International Emergency Economic Powers Act (IEEPA), specifically, the “reciprocal” and “fentanyl” tariffs enacted during the Trump Administration.

Where Things Stand

Hearings began this past week, focusing on whether these IEEPA tariffs were lawfully implemented. While many who follow the Court closely believe that the Supreme Court (SCOTUS) may be considering a decision to overrule the tariffs, there is no certainty about how or when the Court will rule.

The hearings have concluded, but there is no fixed timeline for the final decision. Given that both the plaintiffs (importers) and the defendant (the Trump Administration) have requested an expedited ruling, it’s possible that a decision could come before the end of 2025.

What Could Happen Next

If SCOTUS decides to strike down the IEEPA tariffs, several possible outcomes are on the table:

  • The Court could order refunds of all IEEPA tariffs collected to date, a figure approaching $100 billion.
  • However, the Court might also limit the scope of its decision, defining how the ruling applies to specific cases and establishing detailed guidelines for any refund process.
  • Alternatively, SCOTUS could uphold the tariffs or issue a more nuanced ruling that maintains some aspects while revising others.

At this stage, no one knows exactly what the ruling will look like or how it will impact importers, distributors, and retailers in the home furnishings industry.
